Terms and Conditions

By purchasing a story on mumablue.com, you declare that you have read and accept these Terms and Conditions, as well as our Privacy Policy.

The delivery of the products offered by MUMABLUE (hereinafter, the “Products”) through the website www.mumablue.com requires prior purchase of the Products in accordance with these general terms and conditions, which expressly govern the contractual relationship between CUENTOS COLORÍN, S.L. and third parties who purchase products through the online store (hereinafter, the “Customer”).

CUENTOS COLORÍN, S.L. informs you that the steps required to purchase Products are those described in these Terms and Conditions, as well as any additional steps shown on-screen during navigation. The Customer declares that they are aware of and accept such steps as necessary to access the Products and services offered on the Website.

1. Website Ownership

CUENTOS COLORÍN, S.L. (hereinafter, MUMABLUE), with registered office at Calle Ríos Rosas, 36, 1º Izquierda, 28003 Madrid, Spain, Tax ID No. B87210621, registered with the Madrid Mercantile Registry, is the owner of the website www.mumablue.com (hereinafter, the “Website”) and makes it available to users for the purpose of providing information about MUMABLUE’s products and offers, as well as enabling online purchases.

2. Purpose and Scope

These Terms and Conditions govern the online purchase of Products through mumablue.com and the responsibilities arising therefrom.

Completion of all steps required to purchase Products and submission of an order implies full and unconditional acceptance by the Customer of these Terms and Conditions and the Website’s Privacy Policy, as published at the time of purchase.

3. Purchase Process

To purchase any Product offered on mumablue.com, the Customer must first carefully read these Terms and Conditions.

The Products offered, together with their features and prices, will be displayed on-screen. Any applicable shipping costs will also be displayed at checkout.

To proceed with a purchase, the Customer must select the desired Product and add it to the shopping cart. Prior to checkout, the Customer must verify the Product’s characteristics after personalization, price, applicable taxes, and shipping costs.

MUMABLUE will then request that the Customer provide certain information by completing an online form. All fields marked with an asterisk (*) are mandatory. The processing of personal data is governed by MUMABLUE’s Privacy Policy.

Customers must be at least eighteen (18) years old, or otherwise have express authorization from the account holder whose payment method is used. By placing an order, the Customer declares and guarantees that such authorization exists where required.

The Customer must accept these Terms and Conditions to proceed. Acceptance does not constitute automatic acceptance of the order by MUMABLUE. The order will be deemed accepted once MUMABLUE sends an order confirmation email to the Customer.

Payment may be made by credit or debit card, bank transfer, PayPal, or any other payment method enabled on the Website at the time of purchase.

For payment processing, the Customer will be asked to provide, where applicable:
(a) card number; (b) expiration date; and (c) CVV security code.

To ensure secure transactions, MUMABLUE uses ING Direct virtual POS and Stripe secure payment platforms.

4. Refund and Returns Policy

MUMABLUE Products consist of a 44-page, full-color printed storybook, available in various storylines, with a customizable protagonist (name and appearance). The final product is a hardcover book with laminated, stain-resistant pages, measuring 22 × 22 cm and weighing 0.495 kg.

As part of the personalization process, the Customer may upload a photograph and include a dedication at the end of the book. If the photograph includes third parties, the Customer guarantees they have obtained express authorization to use the image and agrees to indemnify MUMABLUE against any claims.

Images containing harmful content for minors or contrary to Mumablue’s values are prohibited. MUMABLUE reserves the right to reject such images, cancel the order, and notify authorities if necessary.

Before printing, the Customer is provided with a preview of the customized book and must approve it. MUMABLUE assumes no responsibility for content approved by the Customer.

All MUMABLUE Products include a 24-month warranty from the date of receipt, covering manufacturing defects only (printing or binding errors, missing pages, etc.).

If a defect is detected, the Customer must contact MUMABLUE and provide photographic evidence. If confirmed, MUMABLUE will replace the Product at no cost, including shipping.

Order Cancellation

Damage not caused by manufacturing defects (e.g., impacts, environmental damage, improper use, normal wear) is not covered by the warranty.

Due to the personalized nature of the Products, Customers do not have a right of withdrawal and may not return Products without cause within 14 days.

Shipping

Delivery details will be shown in the order. Unless otherwise agreed, shipping is via free standard mail.

Delivery times are estimates only. MUMABLUE is not liable for delays.

The Customer must inspect the Product upon delivery and sign the delivery receipt. A signature constitutes acceptance without visible defects.

Orders may be delivered in multiple shipments, each constituting a separate contract.

Failure to collect an order does not entitle the Customer to a refund.

5. MUMABLUE’s Obligations

MUMABLUE undertakes to:

  • Provide accurate Product information on the Website

  • Send order confirmation emails

  • Deliver Products within legal timeframes

  • Replace Products damaged during shipping

  • Cover shipping costs for confirmed manufacturing defects

  • Perform services with due care and professionalism

6. Responsibilities

The Customer is responsible for:

  • Complying with applicable laws and these Terms

  • Providing accurate and up-to-date information

  • Protecting personal data used for purchasing

MUMABLUE’s liability shall, in all cases, be limited to the purchase price of the Product.

7. Disclaimer of Warranties and Liability

MUMABLUE is not responsible for:

  • Improper use or storage of Products

  • Technical availability of the Website

  • Third-party content or advertising

  • Unauthorized access to user data

8. Intellectual and Industrial Property

All Website and Product content is protected by intellectual and industrial property rights. No rights are transferred to the Customer beyond personal, non-commercial use.

Unauthorized reproduction, modification, or distribution is strictly prohibited.

9. Links

The Website may contain links to third-party websites. MUMABLUE is not responsible for third-party content or services.

Links to the Website require prior written authorization and must comply with these Terms.

10. Duration and Amendments

These Terms remain in effect until modified. Orders are governed by the Terms in force at the time of purchase.

11. Governing Law and Jurisdiction

These Terms are governed by Spanish law.
Any disputes shall be submitted to the courts of Madrid, Spain, with express waiver of any other jurisdiction.

12. Voice Dedication Service

Mumablue offers customers the option to add a voice dedication to certain products.

By using this service, the customer represents and warrants that:

  • They own the rights to the content of the recording or have obtained all necessary permissions and authorizations to use and share the voice contained in the recording.
  • The recording does not contain any unlawful, offensive, defamatory, discriminatory, threatening, or otherwise inappropriate content, nor any content that infringes the rights of third parties.
  • The recording does not infringe any intellectual property rights, publicity rights, privacy rights, image rights, or any other rights belonging to third parties.

The customer shall be solely responsible for the content of any recordings submitted to Mumablue.

Mumablue reserves the right, at its sole discretion, to reject, suspend, remove, or refuse to process any recording that it reasonably considers to be unlawful, in violation of these Terms, or inconsistent with the values and principles of the Mumablue brand.

By purchasing the Voice Dedication service, the customer authorizes Mumablue to store, process, reproduce, and make available the recording solely for the purpose of providing the contracted service.

Recordings may be subject to technical limitations, including but not limited to duration, format, file size, or storage capacity. Any applicable limitations will be communicated to the customer during the ordering process.

Once a recording has been associated with a confirmed and processed order, modification, replacement, or re-recording of the voice dedication may not be possible.

Access to Voice Dedications

Access to voice dedications will be provided through the identification, authentication, or validation mechanisms established by Mumablue.

The customer is responsible for safeguarding any links, codes, credentials, or access information provided for the playback of the voice dedication.

Mumablue shall not be liable for unauthorized access by third parties resulting from the customer's disclosure, misuse, loss, or failure to adequately protect such access information.

Service Availability and Retention

Mumablue will make commercially reasonable efforts to maintain access to voice dedications during the retention period specified in its Privacy Policy.

However, the customer acknowledges and agrees that the service depends on technological infrastructure, hosting services, storage systems, internet connectivity, and third-party providers. Accordingly, Mumablue does not guarantee the permanent, uninterrupted, or indefinite availability of any voice recording.
